Revocation right

 

You may revoke your contractual statement in writing (e.g. by letter, fax message or e-mail) within 14 days without having to state any reasons or – if the matter of when the period expires is left up to you – also by returning the thing.  The period shall run after you have received this instruction in writing, but not, however, before the goods have been received by the consignee (if the same type of goods are sent on a repeated number of occasions, the period shall not begin to run until the consignment has been received) and not before our duties of information have been fulfilled in accordance with Article 246 Section 2 in conjunction with Section 1 Paragraph 1 and 2 of the Implementation Ordinance for the German Civil Code [EGBGB] as well as Section 312g Paragraph 1 Sentence 1 of the German Civil Code [BGB] in conjunction with Article  246 Section 3 Implementation Ordinance for the German Civil Code [EGBGB].  It shall suffice for the revocation or the thing to be sent off in time for the period of revocation to have been observed.  Revocation is to be addressed to:

In the event that revocation is effective, the performances already received by both Parties are to be returned and if applicable benefits derived therefrom (e.g. interest) are to be handed over. You may not return or hand over the performance you have received as well as benefits (e.g. the benefit of use) if all or part of it is in a deteriorated condition.  If so you will have to compensate us for such deterioration.  You will only have to compensate us for the deterioration of the thing in so far as the benefits you have derived or the deterioration are attributable to your use of the thing over and above testing the features of the thing to verify that it is in perfect working order.  By this we mean testing and trying out the respective goods as is, for example, possible and normal in a shop.  Things which can be sent by parcel post are to be returned at our risk.  You will have to pay the normal costs of returning things if the price of the goods supplied does not exceed 40 Euros or if the price of the thing is higher than 40 Euros, you have not yet rendered the counter-performance or a contractually agreed part payment.  Otherwise you will not have to pay for returning the thing. Things which cannot be returned by parcel will be collected from you.  Our commitment to refund payments will have to be fulfilled within 30 days.  The period shall begin to run for you when the declaration of revocation or the thing is sent off and for us upon receipt.

 

General information about processing revocation

1. May we request that you use our form, which you will find in the Download Area, to make processing the cancellation as simple as possible.
2. Please avoid damaging and soiling the goods. If possible, please send the goods to us in the original packaging, including all accessories and all packaging parts. Where applicable use a protective outer packaging. If you no longer have the original packaging, please use suitable packaging for appropriate protection against transport damage.
3. If possible, please do not sent the goods carriage forward. On request we would be pleased to reimburse you for the postage in advance, insofar as you are not required to pay postage.
